Terms of Service

Welcome to Re:WayAI. By accessing or using our GPU cloud computing platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share them with third parties
• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Maintain only one account per individual or legal entity
• Notify us immediately of any unauthorized access to your account

You are fully responsible for all activity that occurs under your account, including actions taken by anyone you grant access to.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. The following activities are strictly prohibited:

• Any illegal activity, including but not limited to fraud, money laundering, or trafficking
• Cryptocurrency mining unless explicitly authorized in writing by Re:WayAI
• Distribution of malware, viruses, or any malicious software
• Generation, storage, or distribution of child sexual abuse material (CSAM)
• Network attacks, port scanning, or unauthorized access attempts against other systems
• Sending unsolicited bulk communications (spam)
• Violating export control laws or sanctions regulations
• Any activity that degrades the Service for other users

Re:WayAI reserves the right to suspend or terminate accounts engaged in prohibited activities without prior notice and without refund.

3. Payment Terms

The Service operates on a credit-based billing system. By using the Service, you agree to the following payment terms:

• Pay-as-you-go billing: Usage is billed per second of active compute time with no minimum commitment
• Fixed-term pricing: Discounted rates are available for committed usage periods; early termination of fixed-term commitments does not entitle you to a refund of the committed amount
• Free credits: New accounts may receive promotional credits subject to the terms specified at the time of issuance; promotional credits are non-transferable and may expire
• Refunds: Consumed credits and used compute time are non-refundable; unused purchased credits may be refunded within 14 days of purchase at our discretion
• Price changes: We may adjust pricing with at least 30 days' notice; existing fixed-term commitments will be honored at the agreed rate

All prices are listed in US Dollars (USD) and are exclusive of applicable taxes. You are responsible for any taxes associated with your use of the Service.

4. Service Availability

We strive to provide reliable, high-availability infrastructure. However:

• The Service is provided on a "best-effort" basis; we do not guarantee 100% uptime
• Planned maintenance may require temporary service interruptions; we will provide advance notice when possible
• GPU availability is subject to demand and hardware capacity; specific GPU types may not be available at all times
• We reserve the right to perform emergency maintenance without prior notice to ensure platform integrity and security

We are not liable for any losses resulting from service interruptions, whether planned or unplanned.

5. Data Handling & Privacy

Your data and privacy are important to us. Our data handling practices are as follows:

• Your data: You retain full ownership of all data you upload, process, or generate using the Service
• Access: Re:WayAI does not access, inspect, or use your data except as necessary for service operation, maintenance, or when required by law
• Data persistence: Data stored on instance volumes is deleted when the instance is terminated; it is your responsibility to back up any data you wish to retain
• No backup guarantee: We do not provide automatic backups of your data; you are solely responsible for maintaining copies of your data
• Account data: We collect minimal account information (email address) necessary to provide the Service; we do not sell your personal information to third parties
• Cookies and analytics: We may use analytics tools to understand how the Service is used in order to improve it
• Data security: We implement industry-standard security measures to protect your data, including encryption in transit and isolated compute environments

6. Intellectual Property

Intellectual property rights are allocated as follows:

• You retain all intellectual property rights to any content, models, code, or data you create, upload, or process using the Service
• Re:WayAI retains all rights to the platform, its software, APIs, documentation, trademarks, and branding
• You may not reverse-engineer, decompile, or attempt to extract source code from any part of the Service
• You grant Re:WayAI no rights to your content beyond what is necessary to provide the Service

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• Re:WayAI is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you paid to Re:WayAI in the 12 months preceding the claim
• We are not responsible for the output, accuracy, or legality of computations or models you run on the Service

8. Termination

• You may terminate your account at any time by contacting us or through your account settings
• Re:WayAI may suspend or terminate your account immediately if you violate these Terms
• Upon termination, your access to the Service will cease and any data on active instances will be deleted
• Remaining credits are non-refundable if your account is terminated for cause (violation of these Terms)
• Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will continue to apply

9. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top of this page
• For material changes, we will notify you via email or through the Service at least 30 days before the changes take effect
• Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you may terminate your account before the changes take effect

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of the Czech Republic.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
