Terms of Service

Welcome to Re:WayAI. By accessing or using our speech-to-text, speaker diarization and speaker attribution platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and API keys and not share them with third parties
• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Maintain only one account per individual or legal entity
• Notify us immediately of any unauthorized access to your account

You are fully responsible for all activity that occurs under your account, including actions taken by anyone you grant access to.

2. Acceptable Use & Recording Consent

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. In particular:

• Recording consent: You represent and warrant that you have all rights, consents and legal bases required to record, upload and process the audio you submit, including any consent required from recorded individuals under applicable recording and data-protection laws (such as the GDPR)
• Voice enrollment: When enrolling a person's voice for speaker recognition, you confirm you have that person's consent to create and use a voice profile on their behalf
• Any illegal activity, including but not limited to fraud, unlawful surveillance, or covert interception of communications, is strictly prohibited
• Distribution of malware, viruses, or any malicious software is prohibited
• Network attacks, port scanning, or unauthorized access attempts against the Service or other systems are prohibited
• Violating export control laws or sanctions regulations is prohibited
• Any activity that degrades the Service for other users is prohibited

Re:WayAI reserves the right to suspend or terminate accounts engaged in prohibited activities without prior notice and without refund.

3. Payment Terms

The Service operates on a credit-based billing system. By using the Service, you agree to the following payment terms:

• Pay-as-you-go billing: Usage is billed per minute of processed audio, per pipeline stage you run, with no minimum commitment; streaming sessions are billed in short increments of streamed audio
• Free credits: New accounts may receive promotional credits subject to the terms specified at the time of issuance; promotional credits are non-transferable and may expire
• Refunds: Consumed credits are non-refundable; unused purchased credits may be refunded within 14 days of purchase at our discretion
• Price changes: We may adjust pricing with at least 30 days' notice

All prices are listed in US Dollars (USD) and are exclusive of applicable taxes. You are responsible for any taxes associated with your use of the Service.

4. Service Availability

We strive to provide reliable, high-availability infrastructure. However:

• The Service is provided on a "best-effort" basis; we do not guarantee 100% uptime
• Planned maintenance may require temporary service interruptions; we will provide advance notice when possible
• Processing capacity is subject to demand; job turnaround times and real-time streaming capacity may vary
• We reserve the right to perform emergency maintenance without prior notice to ensure platform integrity and security

We are not liable for any losses resulting from service interruptions, whether planned or unplanned.

5. Data Handling & Privacy

Voice recordings are sensitive data, and the Service is designed around that. Our data handling practices are as follows:

• Audio deletion: Uploaded and streamed audio is deleted immediately after processing completes; we do not retain source audio after your job finishes
• Processing location: All audio processing takes place within our ISO 27001 certified data center; your audio is never transferred to third-party clouds or external AI services
• Transcripts and results: Transcripts, diarization results and speaker metadata are stored for you until you delete them; you can retrieve, export or delete them at any time via the console or the API
• Voice profiles: Speaker-enrollment voice profiles are stored until you delete them, are used only for jobs where you explicitly request recognition, and are never matched against other customers' audio
• No training on your data: We do not use your audio, transcripts or voice profiles to train models
• Your data: You retain full ownership of all audio you submit and all transcripts and results generated from it
• Access: Re:WayAI does not access, inspect, or use your data except as necessary for service operation, maintenance, or when required by law
• Account data: We collect minimal account information (email address) necessary to provide the Service; we do not sell your personal information to third parties
• Cookies and analytics: We may use analytics tools on our website to understand how the Service is used in order to improve it
• Data security: We are ISO 27001 certified and implement industry-standard security measures to protect your data, including encryption in transit

6. Intellectual Property

Intellectual property rights are allocated as follows:

• You retain all intellectual property rights to the audio you submit and to the transcripts and results generated from it
• Re:WayAI retains all rights to the platform, its software, models, APIs, documentation, trademarks, and branding
• You may not reverse-engineer, decompile, or attempt to extract source code or models from any part of the Service
• You grant Re:WayAI no rights to your content beyond what is necessary to provide the Service

7. Accuracy & Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• Transcription, diarization and speaker attribution are automated processes; while we strive for state-of-the-art accuracy, we do not warrant that any transcript or speaker label is complete or error-free, and you are responsible for reviewing results before relying on them
• Re:WayAI is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you paid to Re:WayAI in the 12 months preceding the claim

8. Termination

• You may terminate your account at any time by contacting us or through your account settings
• Re:WayAI may suspend or terminate your account immediately if you violate these Terms
• Upon termination, your access to the Service will cease and your stored transcripts, results and voice profiles will be deleted
• Remaining credits are non-refundable if your account is terminated for cause (violation of these Terms)
• Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will continue to apply

9. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top of this page
• For material changes, we will notify you via email or through the Service at least 30 days before the changes take effect
• Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you may terminate your account before the changes take effect

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of the Czech Republic.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
